Frequently Asked Questions

Everything you need to know about property purchase taxes in Spain

What is ITP and who pays it?
ITP (Impuesto de Transmisiones Patrimoniales) is the Transfer Tax applied to second-hand property purchases in Spain. It is paid by the buyer. The rate varies by Autonomous Community, typically ranging from 6% to 10% of the purchase price.
What is AJD and when does it apply?
AJD (Actos Jurídicos Documentados) or Stamp Duty applies to new-build properties and mortgage deeds. For new builds, VAT (IVA) at 10% also applies instead of ITP. The AJD rate varies by region, generally between 0.5% and 1.5%.
Can I benefit from a reduced ITP rate?
Yes. Many Autonomous Communities offer bonifications (reduced rates) for specific buyer profiles, such as first-time buyers, buyers under 35, large families, or disabled persons. Andalucía, for example, offers 3.5% ITP for buyers under 35 purchasing their primary residence under €130,000.
Are notary and registry fees mandatory?
Yes. Notary fees are regulated by national scale and typically range from 0.1% to 0.5% of the purchase price. Land Registry fees are also nationally regulated and slightly lower. Both are required to complete a legal property purchase in Spain.
What is a good rental yield in Spain?
A gross yield above 6% is considered good in most Spanish markets, and above 8% is excellent. However, net yield (after operating expenses like IBI, community fees, maintenance, and insurance) is the more meaningful metric — aim for 4%+ net.
